Avanti Equipment Finance LLC ("Avanti," "we," "us," or "our") respects the privacy of the businesses and individuals who visit this website and who apply for equipment financing through us. This Privacy Policy explains what information we collect through avantiequipmentfinance.com (the "Site"), how we use and protect it, and the choices you have. It applies to this Site and to the financing application process we operate. It does not apply to any third-party website that may be linked from the Site; those sites are governed by their own policies.
Because Avanti is a financial company, some of the information we handle is regulated under the federal Gramm-Leach-Bliley Act (GLBA) and related financial-privacy laws. Where those laws apply, we handle your information in accordance with them.
Information we collect
We collect information in three main ways: information you give us, information collected automatically when you use the Site, and information we receive from third parties.
Information you provide. When you submit an application, request a quote or pre-qualification, send us an email, or otherwise contact us, you may provide your name, business name, job title, mailing and email addresses, and phone and fax numbers, along with any other details you choose to share.
Information needed to evaluate financing. Because our core business is equipment financing, an application requires more sensitive details so we can verify identity and assess creditworthiness. These may include your Social Security number, date of birth, business and personal financial information, and bank or account information. You understand that credit history may be a factor in evaluating an application.
Information collected automatically. Like most websites, we automatically log technical information such as your Internet Protocol (IP) address, browser type, device information, the pages you view, and the dates and times of your visits. We use this to monitor and improve the Site. We do not link this technical data to your identity except as needed to operate or secure the Site.
Information from third parties. In connection with an application, we may receive information about you from consumer and business credit reporting agencies, from equipment vendors or dealers through whom you apply, and from the funding sources we work with.
Credit reports and FCRA authorization
By submitting an application, you authorize Avanti Equipment Finance LLC, and any assignee, lender, or funding source that may be involved in your request, to obtain and use consumer and business credit reports about you, now and from time to time, as needed to evaluate, process, and review your application and any resulting account. This authorization continues for as long as it is needed for those purposes. You consent to this use of your credit information under the Fair Credit Reporting Act (FCRA).
As part of pre-qualifying and reviewing your application, we obtain and review your credit. In most cases this is a soft credit inquiry, which does not affect your credit score. Depending on the lender and the stage of your request, a hard inquiry may be required; we obtain a hard inquiry only with the appropriate authorization. Whether a soft or hard inquiry is used can vary by lender.
How we use your information
We use the information we collect to:
- Evaluate, process, and respond to your application or request, including making credit decisions and presenting your request to one or more funding sources;
- Verify your identity and prevent fraud;
- Communicate with you about your application, account, and our services, including by email, phone, and (with your consent) text message;
- Operate, maintain, secure, and improve the Site and our services;
- Carry out and enforce our agreements with you, including billing and collections where applicable; and
- Comply with applicable laws, regulations, and lawful requests, and protect the rights, property, and safety of Avanti and others.
We do not use the sensitive financial information you provide for unrelated purposes.
How we share your information
We share your information only as needed to provide the financing and services you request, or as otherwise described here. Specifically, we may share information with:
- Funding sources, lenders, banks, and their assignees, in order to evaluate and place your financing request;
- Equipment vendors or dealers involved in your transaction, where relevant to completing it;
- Service providers who perform functions on our behalf — such as document handling, email delivery, identity verification, hosting, and security — under obligations to keep the information confidential and use it only for those functions; and
- Government, law enforcement, courts, or other parties when required to comply with applicable law or legal process, to enforce our terms, or to protect rights, property, or safety.
We do not sell your personal information, and we do not share it with unaffiliated third parties for their own marketing.
Text messaging (SMS)
If you opt in to text messages, you may receive SMS messages from Avanti Equipment Finance LLC related to your application, account, financing, and servicing. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, and you can reply HELP for assistance. Carriers are not liable for delayed or undelivered messages.
Opting in to text messages is not a condition of receiving financing or credit approval.
We do not sell or share mobile opt-in information or your consent to receive text messages with any third party or affiliate for their marketing purposes. Information gathered as part of the SMS consent process is used solely to send the messages you requested.
Cookies and similar technologies
We use cookies and similar technologies to keep the Site functioning, remember your preferences, and understand how the Site is used. A cookie is a small file stored on your device. You can set your browser to refuse some or all cookies, but parts of the Site may not work properly if you do. We do not use cookies to track your activity on other companies' websites.
How we protect your information
We maintain administrative, technical, and physical safeguards designed to protect the information in our control against loss, misuse, and unauthorized access, use, alteration, or disclosure, consistent with applicable law including the GLBA Safeguards Rule. Among other measures, sensitive application data is encrypted, and access is limited to those who need it to do their work. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
How long we keep your information
We keep your information for as long as needed to provide our services and for a reasonable period afterward to meet legal, regulatory, tax, accounting, and recordkeeping requirements, to resolve disputes, and to enforce our agreements. Records related to financing applications are generally retained for at least seven years.
Your choices
You can opt out of marketing communications at any time by following the unsubscribe instructions in an email, replying STOP to a text message, or contacting us using the details below. We may still send you non-promotional messages about your application or account. You can also ask us to review, correct, or delete information we hold about you, subject to the legal and operational limits described in this policy.
Your California privacy rights
This section applies to California residents and supplements the rest of this policy. Note that personal information regulated by the GLBA, the FCRA, or the California Financial Information Privacy Act is exempt from the California Consumer Privacy Act (CCPA); much of the information we collect in connection with financing falls into that category.
Subject to those exemptions, in the past twelve months we may have collected the following categories of personal information: identifiers (such as name, address, email, IP address, and Social Security number); financial and customer-records information; commercial information; and internet or network activity. We collect this information directly from you, from equipment vendors or dealers, automatically through the Site, and from third parties such as credit reporting agencies.
We disclose these categories to funding sources, lenders, service providers, and others as described in "How we share your information," for the business purposes described in this policy. We have not sold personal information.
California residents may request access to the categories and specific pieces of personal information we have collected, request deletion, and request correction, subject to exceptions. We will not discriminate against you for exercising these rights. To make a request, contact us using the information below; we will take steps to verify your identity before responding.
Children's privacy
The Site and our services are intended for businesses and for individuals who are at least 18 years old. We do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us so we can remove it.
Links to other sites
The Site may link to websites we do not operate. We are not responsible for the content or privacy practices of those sites, and we encourage you to review their policies.
Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. When we do, we will revise the "Last updated" date above and post the updated policy on this page. Your continued use of the Site after we post changes means you accept them.
